Justin Timberlake's Stalker Slipping Through Legal Cracks

Celebrities get stalked. It's a grim reality that comes with the fame. Justin Timberlake has one that was stalking both Axel Rose and Metalica where in October he won a temporary restraining order against her.
Now, due to some slip ups by Timberlake, the case has become muddy.

Here is the background. A transient by the name of Karen McNeil, a heavyset woman appearing to be in her 50's has already been successfully barred from having contact with other celebrities mentioned prior. At least that's what she claims in her own answers to the court in regards to Timberlake's accusation of stalking. McNeil was actually sentenced to a year in prison in 1995 for having violated her order granted to Axel Rose. Her last celebrity run-in was with Metalica where she is not only barred from contact with the entire band and their families, she's also barred from any contact with the band's fan club.

The court required Timberlake himself to file a statement on his own known as a sworn declaration (an affidavit) in order to gain a longer term order, but he had not. This left only Timberlake's body guards statements verses her own where she claimed (in her answer to the court) to be long time friends with Timberlake. In the legal world, this is not enough to merit a restraining order.
The courts have in turn demanded that Timberlake come to court Monday to testify that he believes he is in danger by this woman. When she was first picked up after his temporary restraining order was issued, she was evaluated and the requirements to hold her on what is known as a 5150 were not met. Without the criteria to hold her being met, she was let go.

The latest development is that due to either Timberlake's inability to make it to court Monday or unwillingness to appear in court, his attorney has sought to have the judge removed (disqualify), buying them more time to put together their case against McNeil.
